Three things decide it: how much, how it happened, and whether the lender allows it at all.

The size of the debt sets the lender

Some lenders cap tax debt consolidation at a fixed amount at 80 percent of the property value, others have no cap but price the risk. Above the caps the choice narrows to specialist lenders.

A payment plan cuts both ways

An active ATO arrangement shows the debt is being managed and some lenders let you keep it. Others want it paid out at settlement. Missed instalments on the plan count as adverse conduct.

Lodgements have to be current

Lenders generally will not refinance tax debt while returns or BAS are overdue. Getting lodgements up to date is step one, and it often changes the balance.

Can I refinance ATO debt into my home loan?

With the right lender, yes. It is treated as a cash-out refinance for debt consolidation, and the lender will want the ATO statement and a reason the debt built up.

Do I need to be on a payment plan first?

Not always. A plan helps with some lenders and is irrelevant to others that pay the debt out at settlement. What every lender wants is that you are engaging with the ATO, not ignoring it.

Is business tax debt treated differently from personal?

Often. GST and PAYG withholding debts sit with the business and some lenders want them paid from business cash flow. Income tax on the individual is easier to consolidate. John checks which it is.

Will the ATO stop me from settling?

The ATO does not block a refinance, but a garnishee or a director penalty notice changes the picture. Tell John early so the payout figure is right on the day.

What if the debt is more than my equity allows?

Then it is a mix: part refinanced, part on a payment plan, or a specialist lender at a higher loan-to-value. John shows the combinations rather than one answer.

Does tax debt show on my credit file?

The ATO can report larger business tax debts that are overdue and not being managed. A payment plan or a dispute generally stops that reporting. John checks the credit file as part of the review.

How long does it take?

Get the lodgements current and the ATO statement first. From there it runs like any refinance, and the timing depends on the lender, the valuation and how quickly the ATO statement arrives. John gives a realistic timeline once the documents are in.
